Terms of Service

1. Introduction

These Terms of Service ("Terms") govern access to and use of TCGListing.co.uk ("Platform", "TCG Listing", "we", "our", "us"). By creating an account, browsing, listing, purchasing, messaging, or otherwise using the Platform, you agree to these Terms together with our Privacy Policy, Cookies Policy and Consumer Rights page, which form part of these Terms. If you do not agree, you must not use the Platform.

2. Who we are

TCG Listing is operated from 12 Ovaltine Court, Kings Langley, WD4 8GU, United Kingdom. 3. Definitions

  • "Buyer" — a User purchasing items through the Platform.
  • "Seller" — a User listing or selling items through the Platform.
  • "Business Seller" — a Seller acting for purposes relating to their trade, business, craft or profession.
  • "Consumer" — an individual acting wholly or mainly outside their trade, business, craft or profession.
  • "Listing" — an offer by a Seller to sell an item.
  • "Content" — anything a User uploads or submits, including listings, images, messages and reviews.

4. Marketplace status

TCG Listing operates solely as an online marketplace connecting Buyers and Sellers of trading card game products. We are not the seller, the buyer, a grading company, an authenticator, a storage provider, or a logistics provider. Except where required by law, contracts for the sale of products are entered directly between Buyer and Seller, and TCG Listing is not a party to them.

5. Eligibility

You must be at least 18, have legal capacity to enter contracts, and provide accurate registration information. We may require identity verification (including seller KYC) at any time.

6. Accounts

You are responsible for account security, safeguarding your login credentials, and all activity under your account. We may suspend or terminate accounts where we reasonably suspect fraud, abuse, counterfeit activity, policy violations, or unlawful conduct.

7. Listings

Sellers warrant that they own or are authorised to sell the items, that listings are accurate and not misleading, that images genuinely represent the actual item, and that items comply with applicable laws. Sellers are solely responsible for their Listing content. We do not review Listings before publication but may remove any Listing at our discretion.

8. Seller status and consumer rights

Sellers must accurately indicate whether they sell as a Business Seller or as a private individual. Where a Buyer who is a Consumer purchases from a Business Seller, the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 apply, including (in most cases) a 14-day right to cancel distance purchases. Sales between private individuals are not covered by those consumer protections, although items must still match their description. See our Consumer Rights page.

9. Authenticity

Sellers are solely responsible for ensuring items are genuine. TCG Listing does not guarantee authenticity, grading accuracy, condition, ownership, or legality. Buyers acknowledge that purchasing collectibles carries inherent risk. Counterfeit, replica, or unofficial "proxy" cards must never be listed as genuine.

10. Transactions

A legally binding contract is formed between Buyer and Seller when an order is completed. TCG Listing is not a party to that contract.

11. Payments and fees

Payments are processed by Stripe through Stripe Connect; you may be required to accept Stripe's terms. We do not store full payment card details. Fees may include:

  • a Seller commission of 3% (on item plus postage);
  • Stripe processing fees (passed through to the Seller);
  • a Buyer administration fee of £0.10 per item;
  • any other fees displayed at checkout.

We may change fees on reasonable notice.

12. Taxes

Prices are shown in pounds sterling. Sellers are solely responsible for determining, collecting and remitting any taxes (including VAT) due on their sales and for their own tax compliance. Buyers are responsible for any import duties, customs charges or taxes on items shipped internationally.

13. Delivery, risk and title

Sellers must dispatch within the stated handling time, package items appropriately, and provide tracking where required. Risk and title in an item pass to the Buyer on delivery. Non-delivery or items lost in transit should be raised through the order so we can investigate; the Seller remains responsible for safe delivery to the Buyer.

14. Returns, cancellations and refunds

Orders may be cancelled before dispatch by either party as described on the Platform, with a full refund. Where the Consumer Contracts Regulations apply (a Consumer buying from a Business Seller), Buyers may cancel within 14 days of delivery; return postage may be the Buyer's responsibility unless the item is faulty or not as described. 15. Seller payouts

Seller payouts are facilitated through Stripe and are released after delivery is confirmed. We may delay or withhold payouts where fraud is suspected, disputes are active, platform policies are breached, or legal obligations require us to do so.

16. Chargebacks

Sellers are responsible for transactions later reversed by chargeback and agree to cooperate with any chargeback investigation. We may recover charged-back amounts, fees and related costs from a Seller's balance or future payouts.

17. Disputes

Users should first attempt to resolve disputes directly through the order. Where resolution cannot be reached, TCG Listing may investigate and may make final decisions regarding marketplace disputes, including refunds, transaction reversals, account sanctions and payout delays. Our decisions are made in good faith based on the available evidence.

18. Off-platform transactions

All transactions arranged through the Platform must be completed on the Platform. Users must not solicit or complete sales off-platform, share contact details to circumvent the Platform, or attempt to avoid fees. Off-platform dealing forfeits all Platform protections and may result in suspension.

19. Messaging and communications

Our messaging is for legitimate, transaction-related communication only. You must not use it to harass, spam, send unlawful or offensive material, or circumvent the Platform. We may monitor, filter and retain messages to enforce these Terms, prevent fraud, and comply with the law.

20. Prohibited conduct

You must not:

  • sell counterfeit, replica, or "proxy" cards as genuine, or stolen goods;
  • infringe intellectual property rights;
  • list illegal or age-restricted items;
  • manipulate or fabricate ratings or reviews;
  • abuse the dispute or chargeback systems;
  • engage in fraudulent, abusive or unlawful conduct, or disrupt the Platform.

21. Intellectual property and takedown

You retain ownership of your Content and grant TCG Listing a worldwide, royalty-free licence to host, display, reproduce and distribute it for the operation and promotion of the Platform. Rights holders who believe a Listing infringes their intellectual property may contact us at legal@tcglisting.co.uk with details; we operate a notice-and-takedown process, will remove infringing Content, and may sanction repeat infringers.

22. Illegal or harmful content

You can report illegal or harmful Content to us at legal@tcglisting.co.uk. We review reports, remove unlawful Content, and may report serious matters to the relevant authorities.

23. Ratings and reviews

We may publish seller and buyer ratings and verification status. You must not write, commission, or incentivise fake or misleading reviews, or suppress genuine ones. Submitting or facilitating fake reviews is prohibited and may be unlawful.

24. Privacy and cookies

We process personal data in accordance with our Privacy Policy and UK GDPR / the Data Protection Act 2018, and use cookies as described in our Cookies Policy.

25. Availability

The Platform is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation and may modify or suspend features.

26. Third-party services

The Platform relies on third parties (for example Stripe, hosting and email providers). We are not liable for failures of third-party services outside our reasonable control.

27. Limitation of liability

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud, or for breach of a Consumer's statutory rights. Subject to that, and to the fullest extent permitted by law, TCG Listing is not liable for counterfeit items, inaccurate listings, grading disputes, delivery failures, user misconduct, or for indirect or consequential loss, loss of profit, or loss of reputation arising from the acts of Buyers or Sellers.

28. Liability cap

Subject to clause 27, and to the extent permitted by law, our total liability to you arising out of or in connection with the Platform shall not exceed the greater of (a) the fees you paid to us in the 12 months before the claim, or (b) £100. This cap does not affect a Consumer's non-excludable statutory rights.

29. Indemnity

Business Sellers, and any User in respect of their unlawful conduct or breach of these Terms, agree to indemnify TCG Listing against claims, losses, costs, penalties and expenses arising from their Listings, items sold, breaches, or unlawful conduct. Nothing in this clause requires a Consumer to indemnify us beyond what is permitted by law.

30. Suspension and termination

We may suspend or terminate accounts at our discretion where necessary to protect users, the Platform, or legal compliance. On termination, in-flight orders and payouts will be settled or refunded as appropriate, and clauses intended to survive (including 16, 21, 27 to 29 and 32) continue to apply.

31. Changes

We may amend these Terms from time to time and will update the "Last updated" date above. Material changes will be notified where reasonable. Continued use of the Platform constitutes acceptance of the revised Terms.

32. General

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect (severability). These Terms are the entire agreement between you and us on this subject. We may assign these Terms; you may not do so without our consent. A failure to enforce a term is not a waiver of it. We are not liable for any failure caused by events beyond our reasonable control (force majeure).

34. Governing law

These Terms are governed by the laws of England and Wales, whose courts shall have exclusive jurisdiction, except where mandatory consumer protections provide otherwise.

35. Affiliate links and third-party listings

Some product pages may display listings from third-party marketplaces such as eBay, shown separately and below our own sellers’ listings and clearly labelled as coming from eBay. These are provided for convenience and are sold by third parties on those platforms, not by us — we are not party to, and accept no responsibility for, any purchase you make there. Where you follow such a link and make a purchase, we may earn a commission through the eBay Partner Network, at no extra cost to you. This never affects the ranking of our own sellers, who always appear first.
